Dino Melaye goes to Supreme Court over planned recall by INEC

Senator Dino Melaye has headed to the Supreme Court to stop INEC from recalling him from the Senate – The Court of Appeal had on March 16, given INEC the go-ahead to continue with the recall – Melaye, through his lawyer, Mike Ozekome, asked the apex court to set aside the March 16 judgment of the Court of Appeal A senator representing Kogi west senatorial district at the Senate, Dino Melaye, has filed an appeal at the Supreme Court, seeking an order to restrain the Independent National Electoral Commission (INEC) from proceeding with his recall from the Senate. The Independent reports that Melaye’s appeal was sequel to a judgment delivered by the Court of Appeal on March 16, which gave INEC the go-ahead to continue with the recall.  We gathered that in a notice of appeal filed by his counsel, Mike Ozekome, (SAN), Melaye wanted an order of perpetual injunction restraining INEC from commencing or further continuing with his recall or acting on the purported petition. Melaye also asked the apex court to set aside the March 16 judgment of the Court of Appeal.  It was reported that in a unanimous decision on Friday, March 16, the court dismissed the appeal filed by Melaye against the judgment of the federal high court delivered last year. The appellate struck out the suit filed at the court on the ground that there was no cause of action and the federal high court that initially adjudicated the case lacked jurisdiction and ought not to have entertained the case in the first place.
